Legal to Build Machine Guns?

Well, they almost got it right, that whacky 9th. Their decision to overtun a conviction for possession of a machine gun is based on the fact that the defendant was a convicted felon previous to being charged for building the unregisterd machine gun.

The machine gun was built entirely from scratch removed the weapon from the stream of commerce along with the fact that the builder was also a convicted felon who cannot legally purchase from the legal market. So the defendant was himself also outside the stream of commerce in the legal “market”.

The Court ruled his building of the unregistered machine guns did not effect interstate commerce and was legal.

What most people may not understand is that the collection of taxes, under the Commerce Clause, is the sole basis for the regulation of machine guns.

Of course the 9th is the most overturned Court in the United States…. even thoug
