Bye-Bye 5th Amendment
I really saw this going the other way. But that was because it would have been logical and Constitutional. The SCOTUS has now effectively stated that the U.S. Constitution means what they think it should mean.
The split of the Justices here is worthy of note. Liberal leaning Justices wrote the majority opinion, you know those who claim to be for the little people?
It did surprise me that Sandra Day O’Connor was among the dissenters. I mean this woman has boasted the use of foreign law in reaching decisions. But she sided with Rinquist this one around. Though 3 of 5 of the majority were appointed by republicans 3 of 4 of the dissenters were also so the appointing party really doesn’t mean much. There seems to be something in the coolaid after a Justice is sworn in.
Anyway, we do still live in somewhat of a Capitalistic society so maybe buying pressures will help curtail the big box store’s exploitation of this.
I’m not holding my breath, mind you.
